These Terms govern the use of localfoodreviews.net, operated by 8978 Tech & Digital Group, Inc. (“Local Food Reviews,” “Company,” “we,” “us,” or “our”). By using the directory or creating an account you agree to these Terms. Additional agreements apply to restaurant owners and specific services.
1. Eligibility and accounts
You must be legally able to accept these Terms. Account holders must provide accurate information and protect account credentials. Restaurant representatives must be authorized to claim or manage the business.
2. Directory service
The directory may display restaurants, cafés, food trucks and other food businesses, with maps, menus, hours, media, specials, ratings, reviews and links. Listings may come from public sources, restaurants and third parties. We cannot guarantee that hours, prices, menus, offers or other information are current; verify important information with the restaurant.
3. Reservations and catering
Submitting an inquiry does not automatically create a confirmed reservation, catering order, deposit or contract. The restaurant or booking provider must confirm the request and is responsible for fulfillment, cancellations and service issues. External reservation and catering providers may have separate conditions.
4. Ordering and third-party links
Restaurant websites, menus, ordering or delivery links may lead to independent companies such as DoorDash or reservation providers. Their terms, prices, privacy practices, service fees, availability and refund policies apply. Local Food Reviews is not the food seller or delivery provider unless expressly stated otherwise.
5. Menus, food safety and allergens
Restaurants are responsible for their own food preparation, food safety, licensing, ingredient information and allergen practices. Visitors with allergies or dietary needs should independently confirm details directly with the restaurant before ordering or dining.
6. Reviews and ratings
Reviews express the opinions of their authors, not guarantees or endorsements by the Company. They must reflect genuine experiences and comply with our Reviews & Community Content Policy. Restaurants cannot delete genuine negative reviews simply because they are unfavorable. We may investigate suspected fraud, impersonation, abuse, spam or infringement and moderate content that violates our policies.
7. User submissions
You retain rights you own in your reviews and submitted media. You grant the Company a nonexclusive, worldwide, royalty-free license to host, reproduce, format, display, moderate, distribute and promote submitted content in connection with the directory. You warrant that your submissions are lawful, truthful as to factual representations, and do not violate third-party rights or reveal private information without permission.
8. Restaurant content
Restaurant owners must have the legal rights, licenses, permissions and necessary releases to submit their menus, photos, videos, logos, promotions, claims and other content. The separate Restaurant Owner Agreement governs their manager portal access and uploads.
9. Plans, placement and AI Reviews
Free and paid plans have different listing allowances and capabilities, as shown at pricing. Paid placement and sponsored content may be labeled; payment does not purchase favorable customer ratings or removal of criticism. Certain paid plans include access to features through AI Reviews, subject to plan entitlements and applicable terms. AI output may require review.
10. Subscription billing and cancellation
Paid subscriptions renew according to the subscription term and billing schedule disclosed at checkout. You may cancel through available account controls or by contacting us. Cancellation stops the subscription from renewing for another term; the plan and its paid features remain active until the end of the current paid subscription term. When that term ends, the restaurant listing automatically downgrades to Free, authorized manager portal access continues, and paid-plan entitlements end. Fees for the current term are non-refundable except where required by law or expressly approved in writing. See our Refund & Cancellation Policy.
11. Acceptable use
You must not post fake reviews, impersonate others, threaten or harass people, upload infringing content, misrepresent menu items, manipulate ratings, send unlawful spam, scrape or overload the site without authorization, bypass security restrictions, distribute malware or use the service unlawfully.
12. Content moderation
We may investigate reports, request evidence, restrict access and remove content that violates these Terms or law. We do not promise independent verification of every review or resolution of every factual dispute.
13. Intellectual property
The Company’s original website design, software, branding, editorial material and other intellectual property remain owned by the Company or its licensors. Third-party materials remain subject to their owners’ rights.
14. Privacy
Our Privacy Policy describes personal information handling and applicable rights.
15. No guaranteed results
Paid or Free listing services do not guarantee traffic, reservations, catering inquiries, review scores, search placement, sales or revenues.
16. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DIRECTORY AND RELATED SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT IMPLIED WARRANTIES. WE DO NOT GUARANTEE ACCURATE, COMPLETE OR UNINTERRUPTED INFORMATION, REVIEWS, MENUS, LINKS, REQUEST SYSTEMS OR THIRD-PARTY SERVICES.
17. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES. OUR AGGREGATE LIABILITY RELATING TO THE RELEVANT SERVICE WILL NOT EXCEED THE GREATER OF FEES PAID TO US FOR THAT SERVICE DURING THE THREE MONTHS BEFORE THE CLAIM OR $100, EXCEPT WHERE APPLICABLE LAW OR A CONTROLLING AGREEMENT REQUIRES OTHERWISE. NOTHING HERE EXCLUDES LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED.
18. Indemnification
To the extent permitted by law, users and business account holders who submit unlawful or rights-infringing material agree to indemnify the Company against third-party claims resulting from their violations of these Terms.
19. Governing law
Colorado law governs except where mandatory law requires otherwise. Disputes are to be brought in appropriate Denver County, Colorado courts unless the law requires another forum.
20. Updates
We may update these Terms with a revised effective date and any notice required by law.
