1. Authorization
By claiming or managing a listing, you represent that you are the restaurant owner or are authorized to act for the operator. We may require reasonable proof and reverse unauthorized claims.
2. Manager portal license
We grant authorized users a limited, revocable, non-exclusive license to use the portal and features available under their current plan. You must not share access with unauthorized individuals, circumvent plan limits, or misuse the software.
3. Upload ownership and permissions
For every uploaded photograph, video, audio clip, logo, menu, graphic, description, offer, or other material, you represent that you own it or have all legally necessary licenses and permissions for our intended display and promotional use. This includes photographer, videographer, designer, copyright, trademark, music, publicity, privacy, and identifiable-person rights and releases where required. Simply finding content online does not authorize reuse.
4. License to display content
You retain ownership of content you own. You grant Local Food Reviews and its technical service providers a worldwide, non-exclusive, royalty-free license during the period content is submitted and as reasonably necessary for authorized operation to host, store, reproduce, resize, crop, transcode, display, distribute, and promote the content in connection with your listing and the directory. Necessary backups, cached copies, and legal records may persist for reasonable periods. You confirm authority to grant this license.
5. Accuracy of listings
You are responsible for business details, menu and ingredient accuracy, price and availability disclosures, hours, promotions, ordering links, legal licenses, food safety and customer service. Restaurants are responsible for honoring their own offers and handling dietary and allergen questions.
6. Reservation and catering inquiries
Where enabled, the portal may transmit diner reservation and catering requests. An inquiry alone is not a confirmed booking. Restaurants are responsible for confirmation, pricing, deposits, fulfillment, communications, cancellation conditions, and applicable laws.
7. Reviews and conduct
You may respond to or report reviews through available tools. You may not buy ratings, post or commission fake reviews, retaliate against reviewers, or require removal of genuine negative feedback. Paid subscriptions do not entitle you to preferential review moderation.
8. Plans and AI Reviews
Available features and allowances are determined by your active plan at pricing. Where bundled, AI Reviews features through ai-reviews.biz are limited to that plan and any applicable provider terms. Review AI outputs before use.
9. Billing, cancellation and downgrade
Paid subscriptions renew according to the subscription term and schedule disclosed at checkout. Under our Refund & Cancellation Policy, canceling prevents renewal for another term but does not end paid features immediately. The current paid plan remains active until the end of the current subscription term. At that time, the listing automatically reverts to Free, manager portal access remains, and paid-only features end. Excess content may be archived or hidden rather than immediately deleted. Refunds are not ordinarily available except as required by law.
10. Copyright and complaints
If you suspect infringement, email policies@8978tech.com with the specific content, location, rights asserted, and contact details. We may restrict disputed content while reviewing complaints and follow legally applicable notice procedures.
11. Security and termination
Protect credentials and notify us of unauthorized access. We may restrict access for nonpayment, security threats, fraud, unauthorized uploads, or material policy violations, subject to applicable law.
12. Disclaimers and liability
THE PORTAL IS PROVIDED ‘AS IS’ AND ‘AS AVAILABLE’ TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DO NOT GUARANTEE SALES, BOOKINGS, RATINGS OR VISIBILITY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY FOR THE RELEVANT SERVICE IS LIMITED TO THE GREATER OF $100 OR FEES PAID FOR THAT SERVICE IN THE PRECEDING THREE MONTHS, EXCEPT WHERE LAW OR A CONTROLLING AGREEMENT REQUIRES OTHERWISE.
13. Indemnification and governing law
To the extent permitted by law, you agree to indemnify the Company for third-party claims arising from unauthorized submitted content, rights violations, deceptive promotions, or restaurant services. Colorado law governs, subject to mandatory protections.
